1. Introduction & Scope

These Terms and Conditions apply to all contracts concluded between Haris Fytoziadis (hereinafter “the Artist” or “I”) and the customer (hereinafter “You”) via this website or through direct email communication. By placing an order, you agree to these terms.

2. Products & Services

I offer three categories of products:

1. Original Artworks: Unique, one-of-a-kind physical pieces created by hand.

2. Fine Art Prints: High-quality reproductions of original artworks.

3. Commissions: Custom artworks created specifically according to your requirements and specifications.

Please note that colors on your screen may differ slightly from the actual colors of the artwork due to monitor settings.

3. Payment

• Originals & Prints: Full payment is required at the time of purchase through the website’s checkout (e.g., Stripe, PayPal).

• Commissions: For custom work, a non-refundable deposit (usually 50%) is required to secure your slot and begin work. The remaining balance is due before the final artwork is shipped.

4. Shipping & Delivery

• Processing Time: Originals and Prints are typically shipped within 3-5 business days. Commissions have their own timeline which will be agreed upon individually.

• Customs & Duties: For international orders (outside the EU), you are responsible for any customs and import taxes that may apply. I am not responsible for delays due to customs.

• Packaging: All artworks are packaged securely to prevent damage during transit.

5. Right of Withdrawal (Returns & Refunds)

As a consumer in the EU, you have a statutory right of withdrawal, but exceptions apply depending on the product type.

A. For Originals and Standard Prints (Right to Return)

You have the right to withdraw from the contract within 14 days of receiving the goods without giving any reason.

• How to Return: Contact me at studio@harisfy.com within the 14-day period.

• Condition: The artwork must be returned in its original, perfect condition and original packaging.

• Costs: You (the buyer) are responsible for the return shipping costs. I strongly recommend using a trackable shipping service.

• Refund: Once I receive the return and inspect its condition, I will refund the purchase price (excluding original shipping costs) within 14 days.

B. For Commissions (No Right to Return)

IMPORTANT EXCEPTION: According to Art. 16(c) of the EU Consumer Rights Directive, the right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalized.

• Therefore, all sales of commissioned artworks are final. Refunds are not possible once the creation process has started, as the work is custom-made for you.

6. Damages in Transit

If your artwork arrives damaged:

1. Take photos of the damaged packaging before opening it.

2. Take photos of the damage to the artwork.

3. Contact me immediately (within 48 hours) at studio@harisfy.com.
I will work with you to resolve the issue (e.g., replacement for prints, or a repair/insurance claim for originals).

7. Copyright & Usage Rights

I, Haris Fytoziadis, retain the full copyright to all artworks created, including Originals, Prints, and Commissions.

• What you own: You own the physical artwork.

• What you do NOT own: You do not have the right to reproduce, scan, or sell copies of the artwork. You cannot use the image for commercial purposes (e.g., merchandise, logos) unless we have a separate written licensing agreement.

• I retain the right to display commissioned works in my portfolio and social media unless otherwise agreed.

8. Governing Law

These terms are governed by the laws of Greece.
